How to report copyright infringement to MediaFire

There's an online form (copy below) ... http://www.mediafire.com/help/submit_a_ticket.php?type=abuse

I suggest you select "report a terms of service violation" rather than filing a "DMCA TakeDown notice",
( although I believe you can do both if you wish ).
http://imageshack.com/a/img24/4424/p5v.gif

[ if you have in-browser blocking software like "NoScript" enabled the form is not properly displayed ]

The MediaFire terms of service include ...

MediaFire Terms of Service

You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to store, share or distribute the Content ...

... If any piece of it was created by someone else, you swear you have their permission to store it for your own use or share it....

... When MediaFire removes or disables Content for policy violations, the user who posted the Content may receive a strike. The user is notified of the violation. Repeated policy violations may result in account termination

If you have given your Freesound an attribution license and someone has reproduced/redistributed it without fully complying with the creative commons attribution license, (see next post), they have infringed your copyright.

Oh, if you also want to make a complaint to YouTube about copyright infringement see ...
http://www.freesound.org/forum/legal-help-and-attribution-questions/34244/69581

If you have given your Freesound an attribution license and someone has reproduced it without fully complying with the creative commons attribution license, (summary below), they have infringed your copyright and you can make a complaint to the website hosting the copy of your sound , ( who will hopefully remove it from their site ).

Creative Commons Attribution License, Restrictions, 4
a. ... You must include a copy of, or the Uniform Resource Identifier (URI) for, this License with every copy of the Work You Distribute ...
b(i) ...the name of the Original Author (or pseudonym, if applicable) if supplied
b(ii) ... the title of the Work if supplied
b(iii) ... the URI, if any, that Licensor specifies to be associated with the Work
http://creativecommons.org/licenses/by/3.0/legalcode
.
If you do succeed in having a infringing file taken down please add a post to this thread with the details to encourage others to do the same

An example of successful Mediafire take-down ...

However the associated YouTube currently still exists , [a screengrab should appear below],
... http://www.youtube.com/watch?v=8xxlL9UBXoE which has inadequate attribution for "juskiddink" : Hidden in "Show more" is a [non-functional] link to juskiddink's Freesound profile, rather than linking to the specific sound used, as required by the attribution license , see "4b(iii)" in my previous post.

@ SoundEffectsFactory

You just corrected the "non-functional" link to juskiddink which is hidden on YouTube page v=8xxlL9UBXoE ...

http://imageshack.com/a/img823/3106/wn4t.gif

and yet did not take that opportunity to change that link to the specific sound of theirs that you've "re-hosted" in the YouTube, as is required by the attribution license condition 4b(iii) , which I mentioned above, ( 2nd post in this thread ) ... http://www.freesound.org/forum/legal-help-and-attribution-questions/34819/73359

I've went back and made-bold the text in my post above about condition 4b(iii), if you still can't see it maybe you should have your eyes laseked. [ I wouldn’t have it done myself though : the prospect of someone pointing a laser at my eye fills me with terror ].

Hi,

Copyright is a form of protection so creators and subsequent owners of original works can control how the works are used. Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.

In the post, the part about re-host files is so wrong...

First: Acording to the licence (human-readable summary) http://creativecommons.org/licenses/by/3.0/ you can re-host the Work in any file services

License
Share — copy and redistribute the material in any medium or format

TL;DR:

License: http://creativecommons.org/licenses/by/3.0/legalcode

c: "Distribute" means to make available to the public the original and copies of the Work or Adaptation, as appropriate, through sale or other transfer of ownership.

h: "Publicly Perform" means to perform public recitations of the Work and to communicate to the public those public recitations, by any means or process, including by wire or wireless means or public digital performances; to make available to the public Works in such a way that members of the public may access these Works from a place and at a place individually chosen by them; to perform the Work to the public by any means or process and the communication to the public of the performances of the Work, including by public digital performance; to broadcast and rebroadcast the Work by any means including signs, sounds or images.

Second: You can make "Collections" of Works

b: "Collection" means a collection of literary or artistic works, such as encyclopedias and anthologies, or performances, phonograms or broadcasts, or other works or subject matter other than works listed in Section 1(f) below, which, by reason of the selection and arrangement of their contents, constitute intellectual creations, in which the Work is included in its entirety in unmodified form along with one or more other contributions, each constituting separate and independent works in themselves, which together are assembled into a collective whole. A work that constitutes a Collection will not be considered an Adaptation (as defined above) for the purposes of this License.

In both cases (Re-Host and Collections) is not infringing copyright and finally for any who read this post, Please read the licence for yourself.

What about the "Under the following terms:" part on http://creativecommons.org/licenses/by/3.0/ ?

Or Section 4. on http://creativecommons.org/licenses/by/3.0/legalcode ?

Perhaps you could update your post to avoid confusion.

CC-BY-3.0 licensed sounds added to collections still have to have attribution, and link [URI] to the original work, ( on Freesound ), to comply with the CC-BY-3.0 license. If the Re-hoster does not comply with all the terms of the CC3.0 license they have infringed the creator's copyright.
