    Stolen Sound


    Hello its been awhile since I've been back but recently someone commented on a sound of mine stating a popular mobile game called "Zombs Royale" used one of my sounds without my permission or credit and used it on works that earn commission when my sound is clearly stated as Non Commercial Creative Commons License. I looked into it and I can clearly tell they used my sound but I have never really had a problem with this and I just want to know what sort of action I should take, or if I should take any action at all?

    P.S I have also had one other situation on a different sound where someone sent me a personal message about it and basically said that he was going to use it in his project and refused to credit me and when I messaged him stating that it is illegal to do so since my license was also Non Commercial he just deleted his account. I just wanted to see what you guys had to say about this as well.

    I would write them a friendly letter on the lines of "I'm pleased that you liked my sound and have used it in your product, however be advised it was actually not free for commercial use. Now, having said that, let's talk about my licensing fee..."
    Keep the contact friendly even if you don't feel like it, but do state unequivocally that you will seek legal assistance if they do not reach some agreement with you.
    If they stonewall, find a lawyer specialized on copyright infringements and sue.
    If he's good, his initial threat of litigation should convince them to settle.
    If it IS your sound modern forensics will have no problem determining this, so they'll burn in court and they'll also have a lawyer who will tell them this.
    Best do a screengrab or something where you sound is identifiable, or download the app so you have evidence.

    Thank you for the very professional approach to my situation. That being said I can't seem to find any mailing address of any kind. I assume since it's a app they may not be considered a major company so would contacting them through their official Instagram/Twitter be professional enough? Also not trying to be greedy but what sort of amount would a licensing fee cost?
